By accessing and using TrendsCoded ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

TrendsCoded provides AI-powered visibility tracking and strategic content intelligence services, including but not limited to:

• AI Answer Labs: Weekly snapshots and analysis across major AI platforms (ChatGPT, Perplexity, Claude, Gemini)
• Visibility Tracking: Monitor your brand's presence in AI-generated responses and rankings
• Factor Weighting Engine: Advanced analytics on what drives AI visibility and ranking decisions
• Buyer Persona Simulation: Strategic content recommendations based on AI decision patterns
• Public List Publishing: Create and share AI-generated ranking lists and insights
• Strategic Content Intelligence: Data-driven recommendations for improving AI visibility

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it current
• Maintain the security of your password and account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use or security breaches
• Use only one account per person or organization

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Infringe on intellectual property rights of others
• Transmit harmful, malicious, or unauthorized code or content

The Service and its original content, features, and functionality are owned by TrendsCoded and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content: You retain ownership of content you create using our Service, but grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with providing the Service.

Our Content: All trademarks, service marks, and trade names used on the Service are the property of TrendsCoded or their respective owners.

Billing: Paid services are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as specified in our refund policy.

Price Changes: We may change our pricing with 30 days' notice to existing subscribers. Price changes will not affect your current billing period.

Taxes: You are responsible for all taxes associated with your use of the Service. We may suspend or terminate your account for non-payment of fees.

Refunds: Refunds are handled on a case-by-case basis. Contact our support team for refund requests.

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our data collection, use, and protection practices.

Data Ownership: You retain ownership of your visibility data, entity lists, and analytics. We only use aggregated, anonymized data to improve our services.

Data Retention: We retain your data only as long as necessary to provide our services, comply with legal obligations, and improve our platform performance.

Our Service uses artificial intelligence and machine learning to provide insights and recommendations. You understand that:

• AI-generated content and rankings are based on available data and algorithms
• Results may vary and are not guaranteed to be accurate or complete
• We continuously improve our AI models using aggregated, anonymized data
• AI insights are provided for informational purposes and should not be the sole basis for business decisions

If you access our Service through APIs or integrations, you agree to:

• Respect our rate limits and usage quotas as specified in your plan
• Not attempt to circumvent or exceed these limits through multiple accounts or automated systems
• Use API keys securely and not share them with unauthorized parties
• Notify us immediately if your API keys are compromised
• Comply with any third-party service terms when using our integrations

Rate Limiting: We implement rate limiting to ensure fair usage and system stability. Excessive requests may result in temporary or permanent access restrictions.

Service Availability: We strive to maintain high service availability but cannot guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect service availability.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

IN NO EVENT SHALL TRENDSCODED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

By You: You may terminate your account at any time by contacting our support team or using the account deletion feature in your dashboard.

By Us: We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Effect of Termination: Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

Your continued use of the Service after any changes to these Terms constitutes acceptance of the new Terms.

These Terms shall be interpreted and governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Delaware.

Dispute Resolution: Before filing any formal legal action, we encourage you to contact us first to attempt to resolve any disputes informally.

Minimum Age: You must be at least 18 years old to use our Service. If you are under 18, you may only use our Service with the involvement and consent of a parent or guardian.

COPPA Compliance: We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13, we will take steps to delete such information.

Parental Consent: If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately.

We shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, labor strikes, or any other cause which is beyond our reasonable control.

In the event of such circumstances, we will use reasonable efforts to resume performance as soon as practicable.
